TERMS OF USE
These terms of use (hereinafter the "ToU") define the rights and obligations of visitors to the site www.olive-crowd.com (hereinafter referred to as "the Site") and are agreed between each visitor and Olive Crowd, as operator and publisher of the Site.

1. OBJECT
The purpose of the ToU is to define the terms and conditions under which Crowd Invest Ltd, hereinafter referred to as the PUBLISHER, makes a Site available to its users, hereinafter referred to as the "Users".
A User may be a simple "Internet User" of the Site, a "Member" of the Site, or an "Investor" in a target company.
The simple "Internet User" can only access general information relating to the services offered by the Site and their presentation as well as the legal notices.
The relationship between the Investor and the target company are governed by the contractual documents concluded between them.
Any connection to the Site is subject to compliance with these Terms of Use.
For the Visitor and any User, simply accessing the PUBLISHER's site at the following URL address "https://www.olive-crowd.com/" implies acceptance of all the conditions described below.
2. AVAILABILITY OF THE SITE
The PUBLISHER endeavours to allow access to the Site 24 hours a day, 7 days a week, except in the event of force majeure or an event beyond the PUBLISHER's control, and subject to possible breakdowns and maintenance interventions necessary for the proper functioning of the Site.
Consequently, the PUBLISHER cannot guarantee the availability of the Site and/or services, the reliability of transmissions and performance in terms of response time or quality. No technical assistance is provided to the User by electronic or telephone means.
The PUBLISHER cannot be held liable in case of inability to access to this site and/or use of the services.
Furthermore, the PUBLISHER may interrupt the Site or part of the services at any time without notice, without any right to compensation. The User acknowledges and accepts that the PUBLISHER shall not be liable for any interruptions, and for the consequences that may affect the User or any third party.
3. STATUS OF THE USER OF THE SITE
The Internet visitor can have a status defined according to his activity on the Site:
- The status of "Internet user" qualifies the Internet users who are natural persons or legal entities who can access general information relating to the services offered by the Site and their presentation as well as the legal notices.
- The status of "Visitor" qualifies Internet users, whether individuals or legal entities, who have registered and opened a Visitor account and who can access certain limited areas on the Site without being able to access the services offered by Olive Crowd.
- The status of "Member" qualifies any Internet user who is a natural person or legal entity registered on the Site as a visitor and whose investor file has been completed. His membership having been accepted by Olive Crowd, he/she can benefit from the services described in the Service Agreement and use the platform to transmit funds to the target company as part of a fundraising campaign.
- The status of "Investor" qualifies users who have invested in a Company via the Site.
Users are informed of their change of status by the PUBLISHER by e-mail and on the Site.
4. CREATION OF A VISITOR ACCOUNT
The creation of an account is free. Any person prior to the request for creation guarantees that he or she is of legal age and has full power, right, authority and capacity to sign all the commitments resulting from these ToU and to perform the obligations stipulated herein and which arise therefrom; that, in the case of a legal entity, acceptance of these ToU and the performance of the operations provided for herein have been duly authorised by the competent bodies, that submission to these ToU and the performance of the operations provided for herein do not contravene any applicable law or regulation or any judicial decision or authorisation to which the person is subject.
Users give their real name and real information about themselves and do not provide false or misleading personal information and do not create an account for another person without his/her authorisation.
5. SAFETY
The account is created using an email and a password. A User can only create one personal account and must update his or her contact information, which must be accurate and up-to-date. He/she must not communicate his/her password, let anyone access his/her account or do anything that could compromise the security of his/her account. User IDs and passwords are personal and unique to Users.
Each User agrees not to disclose them and to protect their confidentiality and is solely responsible for their use. Any use of the Site by a third party with the identifiers and passwords is deemed to be made under the responsibility and with the agreement of the User.
The PUBLISHER reserves the right to withdraw or delete an account whose use does not comply with the present terms of use or whose information reveals the User's non-compliance with the terms and conditions for the creation of accounts contained herein.
A User must, if he/she notices any abnormal operation of his/her account, oppose his identifiers and passwords and notify it to: [email protected]. It will be up to the PUBLISHER to decide whether to block his/her account as soon as possible and to assign him/her a new password/identifier.
6. PERSONAL DATA AND CONFIDENTIALITY
The information provided on the Site is confidential and reserved for the internal use of THE PUBLISHER. The User may have access to data of a personal nature. The information collected by the PUBLISHER, will be used and will be the subject of diffusion to third entities only for the only necessities of the execution of the present or to answer the legal and regulatory obligations.

The User may have access to various personal data concerning, in particular, target projects and holdings. He or she undertakes to keep this data confidential, not to transfer it, nor to make any use whatsoever of it that is not directly covered by the present terms and conditions. It will take care to protect access to this data.
The User may receive request for communication of personal data concerning him/her, if necessary to demand their correction and to oppose, for legitimate reasons, their processing or their use for purposes other than those mentioned above.

7. INTELLECTUAL PROPERTY OF THE SITE AND ITS CONTENTS
The general structure of the Site as well as the texts, graphics, images, sounds and videos comprising it, are the property of the PUBLISHER or its partners. Any representation and/or reproduction and/or partial or total exploitation of the contents and services offered by the Site by any process whatsoever, without the prior written permission of the PUBLISHER and/or its partners, is strictly prohibited and would be likely to constitute an infringement.
8. RESPONSIBILITY
The information and/or documents appearing on this Site and/or accessible through this Site come from sources considered to be reliable. However, this information and/or documents may contain technical inaccuracies and typographical errors. The PUBLISHER reserves the right to correct them as soon as these errors are brought to its attention.
It is strongly recommended to check the accuracy and relevance of the information and/or documents made available on this Site. The information and/or documents available on this Site may be modified at any time and may have been updated. In particular, they may have been updated between the time they are downloaded and the time the User becomes aware of them.

The PUBLISHER shall not be liable for any loss, prejudice, damage or penalty of any nature whatsoever suffered by any User, directly or indirectly, due to the use by an unauthorised third party of the User's identifiers, password and account in the absence of fault or gross negligence on the part of the PUBLISHER.

It is possible to create a link to the presentation page of this site without the express authorisation of the PUBLISHER. No authorisation or request for prior information may be required by the PUBLISHER with respect to a site that wishes to establish a link to the Site. However, the PUBLISHER reserves the right to request the deletion of a link that it deems to be inconsistent with the purpose of the Site.
10. COOKIES
The use of the functionalities of the Site may require the installation of "cookies". "Cookies" are activated by the Editor for each use of the Site and are not stored in the Visitor's / Member's computer, which retains its anonymity. "Cookies" do not allow the Publisher to identify the Visitor/Member. They only record information relating to the latter's browsing on the Site (the pages consulted, the date and time of consultation, etc.).
Any User may object to the recording of "cookies".
11. DURATION OF THE CONTRACT - TERMINATION
The present general conditions are concluded from the first use of the Site by the User and for a period of 2 years from the last use.
12. MODIFICATION OF THE ToU OF THE SITE
These ToU may be modified at any time without notice. The User is thus invited to regularly consult their latest updated version, available to all and permanently accessible on the home page of the Site, by clicking on the "ToU" link.
13. DIVISIBILITY OF THE CLAUSES
The nullity, illegality, inapplicability or unenforceability of any clause of these ToU shall not entail the nullity, illegality, inapplicability or unenforceability of the other clauses.
14. JURISDICTION AND APPLICABLE LAW
These ToU are governed, interpreted and applied in accordance with Mauritian law.
